2. What data we process
We process the data you give us and the data generated when we provide the service to you:
- If you make an enquiry (form, email, telephone or WhatsApp): your name, your email address or telephone number, the urbanisation and town where the property is located, the type of property, the dates when you usually visit and whatever you tell us in your message.
- If you are a client: your identification and contact details, the address and characteristics of the property, billing and payment details, the people you authorise to collect the key or enter the property, the visit reports with their photographs and our communications with you.
- If you use the client area: your username, your encrypted password and the documents we make available to you (invoices, reports and communications).
- When you browse the website: technical data such as your IP address, the date and time of access and the type of browser, which the server logs for security reasons.
If you give us other people’s data (for example, a family member, a tenant or a contact person), you must have informed them beforehand and have their permission.
3. What we use your data for and on what legal basis
- To reply to your enquiry and prepare a proposal for you. Legal basis: taking steps at your request prior to entering into a contract, and your consent when you submit the form.
- To provide the service you have contracted: holding the key, visiting the property, sending you the reports, managing the key handovers you authorise and dealing with your requests. Legal basis: performance of the contract.
- To invoice you and meet our tax and accounting obligations. Legal basis: compliance with legal obligations.
- To keep the website and the client area secure. Legal basis: our legitimate interests in preventing unauthorised access and fraudulent use.
- To measure how the website is used with Google Analytics, only if you accept analytics cookies. Legal basis: your consent.
We will only send you marketing communications if you have agreed to this or if, as a client, they relate to services similar to those you have contracted. In both cases you can unsubscribe at any time.
We do not take automated decisions or carry out profiling using your data.
4. How long we keep the data
- Enquiries that do not lead to a contract: a maximum of twelve months from the last contact.
- Client data: for as long as the relationship lasts and, after that, blocked for the periods during which legal liability may arise (as a general rule, six years for accounting and tax records).
- Visit reports and photographs: for as long as the service lasts. When it ends, they are kept blocked for the period during which claims may arise and are then deleted.
- Technical server logs: for a short period set by our hosting provider.
- Analytics data: for the period set in Google Analytics, up to a maximum of fourteen months.
5. Who we share your data with
We do not sell your data. Only the following have access to it:
- The members of our team who deal with your enquiry or visit your property.
- The providers that supply services to us and act as processors on our instructions: IONOS Cloud S.L.U. (website hosting and domain services), Google Ireland Limited (Google Workspace and Google Drive, for documents, reports and photographs; Google Analytics and Google Tag Manager, for website analytics if you accept it) and our tax and accounting advisers.
- WhatsApp Ireland Limited, when you or we use WhatsApp to communicate. WhatsApp processes the conversation data in accordance with its own privacy policy.
- The repair or maintenance contractors you ask us to give access to the property, and only with the data they need for their work.
- Banks, to manage payments received and made, and public authorities, the courts and law enforcement bodies where a law requires us to do so.
The website loads its fonts from the Google Fonts servers. To do this, your browser sends your IP address to Google. Google Fonts does not set cookies.
6. International transfers
Google and WhatsApp may process data outside the European Economic Area. In those cases, the transfer is covered by an adequacy decision of the European Commission or by the standard contractual clauses it has approved.
7. Your rights
You can exercise the following rights at any time:
- Access: to know what data of yours we process and to obtain a copy.
- Rectification: to have inaccurate or incomplete data corrected.
- Erasure: to ask us to delete your data when it is no longer needed.
- Right to object: to object to processing based on our legitimate interests.
- Restriction of processing: to ask us to stop using your data while a complaint is being resolved.
- Data portability: to receive your data in a commonly used format or have us send it to another company.
- Withdrawal of consent: to withdraw it at any time, without affecting processing already carried out.
To exercise them, write to us at info@fivenda.com or at our postal address and tell us which right you wish to exercise. We may ask you to prove your identity. We will reply within one month at the latest.
If you consider that we have not dealt with your request properly, you can lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, www.aepd.es).
8. What data is required
To reply to an enquiry we need at least your name, the location of the property and a means of contacting you. To contract the service we also need your identification details, the property details and your billing details. Without them we cannot help you.
9. Security
We apply reasonable technical and organisational measures to protect your data: an encrypted connection (HTTPS), password-protected access to the client area and access limited to the people who need it for their work.
10. Cookies
This website uses two types of cookies:
- Technical cookies, which are necessary for the website to work and do not require your consent: pll_language remembers the language in which you view the website (one year); fv_consent stores your decision on analytics cookies (one year); and the WordPress session cookies, which are set only when you log in to the client area.
- Analytics cookies, which are third-party cookies and are set only if you accept them in the cookie banner. We use Google Analytics, loaded through Google Tag Manager, to find out how many people visit the website and which pages they view. It sets the _ga and _ga_* cookies, which last up to two years and distinguish one visitor from another without identifying you by name. The provider is Google Ireland Limited.
You can accept or reject analytics cookies in the banner that appears on your first visit, and change your decision at any time using the ‘Cookies’ link in the footer. If you reject them, the website works just the same.
We do not use advertising cookies. If this changes, we will ask for your consent before setting them.
11. Minors
Our services are intended for adults. We do not knowingly collect data from minors.
12. Changes to this policy
We may update this policy to reflect changes in the law or in the service. We will publish the current version here with its date. If there are any differences between the versions in different languages, the Spanish version prevails.
